Summary

NS Environment Act Amendments

The recent Environment Act amendments have expanded the definition of "contaminated site" in a way that allows the Department to fully utilize the legislation and proceed with developing regulations dealing with contaminated sites.

The Amendments do NOT affect how sites are dealt with in practice.

Additional changes to the Act will give the Department an ability to develop Regulations around the following:

• how persons responsible for contaminated sites enter and exit the process
• requirements for site assessment and remedial plans
• an ability to use "voluntary remediation agreements"
• remedial criteria, including risk based criteria
• reporting and closure mechanisms, including property use certificates and environmental notices
• site professional qualifications and insurance
• regulatory liability issues following closure, including the ability to transfer liability

NSEL intends to consult during development of these Regulations.
